Cannabis in Argentina: laws, Medical Uses, Enforcement

Argentina maintains a regulated framework for medical cannabis; however, this should be distinguished from recreational legalization. As of September 2026, the recreational use of high-THC cannabis remains prohibited, while medical applications, authorized cultivation, and specific sectors of the cannabis and hemp industries continue to operate under established regulatory oversight.

Recreational Cannabis Laws

Argentina does not currently maintain a legal framework for a recreational cannabis market comparable to those established in Uruguay or various jurisdictions within the United States.

Pursuant to the national narcotics statute, Law 23.737, the unauthorized cultivation, production, distribution, and commercialization of narcotics are subject to significant criminal penalties. Article 5 of the law stipulates prison sentences ranging from four to fifteen years for such offenses.

It is essential to distinguish between decriminalization and legalization. While Argentine law provides limited protections regarding the possession of cannabis for personal consumption under specific circumstances, this does not constitute the legalization of a recreational market, nor does it render recreational cultivation lawful. Official government guidance confirms that psychoactive cannabis containing more than 1% THC remains prohibited for recreational use.

Law Enforcement

Consequently, enforcement efforts are primarily directed toward unauthorized cultivation, trafficking, commercial distribution, and the possession of narcotics as defined by prevailing legislation.

For visitors, it is advisable to proceed under the assumption that recreational cannabis remains prohibited. The presence of a structured medical cannabis framework should not be interpreted as authorization for the recreational possession, purchase, or transport of such substances.

Medical Cannabis

The medical cannabis sector in Argentina has experienced significant maturation.

Law 27.350 established the comprehensive framework for the medical and scientific use of cannabis within the country. Under this legislation, patients with a verified medical indication may access authorized medicinal products, whether produced domestically, prepared as magistral formulations, or, under specific circumstances, imported.

The primary regulatory mechanism governing this access is REPROCANN, the national cannabis program.

Registered patients who possess valid medical authorization are permitted to cultivate cannabis for medicinal, therapeutic, or palliative purposes. Current regulations further extend this authorization to include cultivation conducted by designated third parties or licensed organizations.

According to the official REPROCANN guidelines, authorized patients are permitted to maintain up to nine flowering plants and, subject to their authorization, are entitled to transport up to 40 grams of dried flowers or six 30-ml dropper bottles of cannabis oil.

CBD in Argentina

CBD is not simply an unrestricted consumer product.

Argentina regulates cannabis-derived products according to their composition, intended use and regulatory category. Medicinal cannabis products are subject to health and regulatory requirements.

For example, Argentina’s health regulations created a category for plant-based cannabis products intended for human medical use. Products containing more than 1% THC can fall under the stricter psychotropic-substance regime.

This is particularly important for tourists because a product being advertised as “CBD” does not automatically mean that it can be freely imported, sold or carried into Argentina.
